以上項(xiàng)目概述中的位置、范圍、項(xiàng)目性質(zhì)、土地性質(zhì)和土地指標(biāo)應(yīng)附相關(guān)政府部門的批準(zhǔn)文件,并以最新的批準(zhǔn)文件為準(zhǔn)
第三條乙方確認(rèn)其已取得《房地產(chǎn)開發(fā)有限責(zé)任公司項(xiàng)目國(guó)有土地使用權(quán)》并取得《國(guó)有土地使用證》。土地使用權(quán)出讓金已全額支付。同時(shí),乙方確認(rèn)該項(xiàng)目已獲得以下批準(zhǔn)和證書

5。乙方有市房地產(chǎn)開發(fā)建設(shè)領(lǐng)導(dǎo)小組辦公室下發(fā)的《關(guān)于長(zhǎng)安寺公共建設(shè)和住宅建設(shè)項(xiàng)目的通知》
6。乙方已獲得市規(guī)劃局土地管理局《長(zhǎng)安寺項(xiàng)目規(guī)劃建設(shè)面積指數(shù)說明》

11。乙方已從市衛(wèi)生局取得年、月、日、日資質(zhì)預(yù)審字第號(hào)《建設(shè)項(xiàng)目設(shè)計(jì)衛(wèi)生審查批準(zhǔn)書》
12。乙方擁有市發(fā)展計(jì)劃委員會(huì)的年、月、日收購(gòu)、申集頭變字第13號(hào)備忘錄。乙方已獲得市人防辦人防工程批復(fù)(uuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuu。乙方有市人防工程質(zhì)量監(jiān)督站人防質(zhì)量監(jiān)督審批字第號(hào)《人防地下室建設(shè)審批通知書》

第五條本合同簽訂后30天內(nèi),乙方應(yīng)按照國(guó)家有關(guān)規(guī)定和文物管理部門的要求,負(fù)責(zé)項(xiàng)目用地的地下文物綜合勘查,并提供書面文物勘查報(bào)告。項(xiàng)目一期土地上的文物勘探費(fèi)用由乙方承擔(dān),二期土地上的文物勘探費(fèi)用由甲方或沈陽(yáng)房地產(chǎn)有限公司承擔(dān)。,有限公司
乙方確認(rèn),在本項(xiàng)目開發(fā)建設(shè)期間,乙方投資的國(guó)有土地使用權(quán)中不存在“文物遺址就地保護(hù)”,如果房地產(chǎn)公司:。,經(jīng)國(guó)家文物行政管理部門確認(rèn)后,發(fā)現(xiàn)需要就地保護(hù)的文物、遺址,導(dǎo)致項(xiàng)目開發(fā)失敗的,甲方應(yīng)退出項(xiàng)目開發(fā),乙方自行處理。乙方應(yīng)在收到國(guó)家文物局確認(rèn)需要在現(xiàn)場(chǎng)保護(hù)文物和遺址的文件后十天內(nèi),將房地產(chǎn)公司投資于該項(xiàng)目的所有費(fèi)用轉(zhuǎn)交給甲方和甲方。,應(yīng)退還第6條付款和付款條件。本合同生效后天內(nèi),甲方應(yīng)向乙方支付1000萬元人民幣作為履行本合同的保證金,乙方應(yīng)向甲方出具相應(yīng)的合法有效的收款憑證。本合同簽訂后個(gè)月內(nèi),甲、乙雙方根據(jù)市計(jì)委關(guān)于項(xiàng)目立項(xiàng)計(jì)劃變更的要求,共同制定市規(guī)劃國(guó)土資源局關(guān)于國(guó)有土地使用權(quán)變更的要求和措施,在準(zhǔn)備好所有相關(guān)材料并向相關(guān)部門提交變更申請(qǐng)后,甲、乙雙方應(yīng)共同將乙方轉(zhuǎn)讓給中信實(shí)業(yè)B
