1甲方擁有年、月、月的繼承權(quán)□, 集體分工□, 購(gòu)買□, 其他方式□ 于年月日取得該地塊的土地使用權(quán),該地塊的規(guī)劃用途為,規(guī)劃建筑面積為平方米,土地使用權(quán)期限為年月日至年月日,土地使用權(quán)證書(或土地使用紅線圖)編號(hào)為2。乙方是具有獨(dú)立法人資格和資金的個(gè)人代表
甲、乙雙方在平等自愿的基礎(chǔ)上簽訂本合作建房合同,第二條合作房屋甲方同意根據(jù)現(xiàn)狀提供上述第一條所述地塊的土地使用權(quán),乙方同意按照約定提供建設(shè)資金,雙方合作開發(fā)并完成本項(xiàng)目建設(shè)總建筑面積為平方米的住宅樓第三條住房建設(shè)資金經(jīng)協(xié)商,雙方同意甲方提供的上述地塊按當(dāng)時(shí)市場(chǎng)價(jià)值人民幣元整(¥:000000.00),作為合作建房資金,乙方應(yīng)出資人民幣:\\uuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuuu。實(shí)際建設(shè)成本高于或低于預(yù)計(jì)金額的部分由房屋建設(shè)資金承擔(dān)和享有,是指自本合同生效之日起至房屋驗(yàn)收合格、甲方取得房地產(chǎn)證書時(shí)所需的全部成本和費(fèi)用。建設(shè)資金不包括甲方為取得土地使用權(quán)應(yīng)支付的土地使用費(fèi)或通過(guò)劃撥方式取得土地使用權(quán)應(yīng)支付的地價(jià)。第四條資金的監(jiān)督和支付住房建設(shè)資金應(yīng)由甲方和乙方共同監(jiān)督。乙方的資金應(yīng)在本協(xié)議簽訂之日到位協(xié)議,存入雙方指定賬戶,由雙方共同管理和支付。所有付款,如材料采購(gòu)和項(xiàng)目資金支付,只有在雙方簽字后才有效
第五條審批程序和房地產(chǎn)權(quán)證的辦理除甲方要求的審批程序外,甲乙雙方應(yīng)共同負(fù)責(zé)辦理包括本合同在內(nèi)的所有審批程序,甲方有義務(wù)及時(shí)提供辦理審批程序所需的資料;由于當(dāng)?shù)胤ㄒ?guī)和法律規(guī)定,房地產(chǎn)權(quán)證只能是土地使用權(quán)的所有人,因此房地產(chǎn)權(quán)證只能由甲方辦理,但產(chǎn)權(quán)歸甲、乙雙方所有。第六條產(chǎn)權(quán)共享所有建筑物的產(chǎn)權(quán)由甲、乙雙方按以下方式或比例共享:甲方擁有樓層房屋的產(chǎn)權(quán),乙方擁有樓層房屋的產(chǎn)權(quán)。甲乙雙方應(yīng)在天內(nèi)辦理該房屋的房地產(chǎn)證。辦理產(chǎn)權(quán)證后,乙方的部分產(chǎn)權(quán)可到公證處辦理產(chǎn)權(quán)捐贈(zèng)或轉(zhuǎn)讓手續(xù),使乙方的產(chǎn)權(quán)合法化第七條設(shè)計(jì)、建筑工程設(shè)計(jì),建筑的招投標(biāo)和施工監(jiān)理由甲、乙雙方共同承擔(dān)。根據(jù)本合同第六條的規(guī)定,應(yīng)將產(chǎn)權(quán)分配給甲方的設(shè)計(jì)圖紙?zhí)峤粚徟?,并?jīng)甲方書面批準(zhǔn)后方可實(shí)施。根據(jù)本合同第6條規(guī)定應(yīng)將產(chǎn)權(quán)分配給乙方的設(shè)計(jì)圖紙須經(jīng)乙方書面批準(zhǔn)后方可提交審批并實(shí)施。工程設(shè)計(jì)招標(biāo)應(yīng)在天內(nèi)于天內(nèi)在天內(nèi)進(jìn)行,整個(gè)建設(shè)項(xiàng)目應(yīng)在合同生效后天內(nèi)開工,竣工驗(yàn)收應(yīng)在個(gè)月內(nèi)完成,第8條建筑裝修標(biāo)準(zhǔn)?;A(chǔ)應(yīng)按照現(xiàn)行建筑標(biāo)準(zhǔn)開挖至米深。地梁采用混凝土鋼筋砌筑,采用鋼筋。整個(gè)房屋應(yīng)采用框架結(jié)構(gòu)。房屋外預(yù)留道路、路面采用混凝土鋪裝,做好路基連接及室外排水工程。外墻裝飾標(biāo)準(zhǔn):4。室內(nèi)裝修標(biāo)準(zhǔn):5。水電安裝及安裝標(biāo)準(zhǔn):6。樓梯裝修標(biāo)準(zhǔn):7。門窗裝修標(biāo)準(zhǔn):第九條雙方的權(quán)利和義務(wù)。甲方和乙方確認(rèn)該房地產(chǎn)和土地為一體,雙方分別占該房地產(chǎn)和土地所有權(quán)的50%。條件成熟時(shí),將土地使用權(quán)登記變更為雙方共有或戶籍
2。自本協(xié)議簽訂之日起,甲方保證乙方在土地權(quán)屬不變登記期間享有該產(chǎn)權(quán)共有人的權(quán)利。本條款不得撤銷。自房地產(chǎn)開始建設(shè)之日起,雙方應(yīng)承擔(dān)房地產(chǎn)建設(shè)用地規(guī)劃許可證、建設(shè)許可證等相關(guān)事宜(包括政府各部門的罰款和公關(guān)費(fèi)用)
4。自本協(xié)議簽署之日起,如果該物業(yè)被政府征用或發(fā)生強(qiáng)制拆遷,雙方應(yīng)獲得相關(guān)補(bǔ)償的50%,包括該物業(yè)和土地的拆遷收入(包括拆遷補(bǔ)償費(fèi)、拆遷安置財(cái)產(chǎn)、現(xiàn)金補(bǔ)償)。雙方應(yīng)響應(yīng)政府號(hào)召,共同遵守法律法規(guī)和城市建設(shè)規(guī)劃,共同維護(hù)雙方權(quán)益,相互配合
